3. DATA PROTECTION AT A GLANCE

GENERAL NOTICES

The following notices are intended to give you a simple overview of what happens with your personal data when you visit this website. Personal data is all data with which you can be identified personally. Detailed information on the subject of data protection is provided in this data protection declaration.

DATARECORDING ON THIS Website

On the one hand, your data is collected because you communicate this to us.

DVS as the controller processes personal data only in compliance with the relevant data protection provisions, particularly when the data processing is required or stipulated by law in order to render our contractual services including the online service or in conjunction with the compliance with our purposes according to the articles of association. Personal data is regularly processed only after the consent of the person in question. One exception applies to those cases in which it is not possible to obtain consent beforehand for actual reasons and the processing of the data is allowed by statutory rules. Otherwise, reference is made to Article 6, Paragraph 1 of GDPR as the legal basis.

Other data is recorded by our IT systems automatically or after your consent when visiting the website. That is primarily technical data (e.g. Internet browser, operating system or time of the site visit). This data is recorded automatically as soon as you enter this website.

When visiting this website, your surf behaviour may also be evaluated statistically. That primarily happens with so-called analysis programs. In Point 10, you can find detailed information about the analysis program utilised by us.

Intended purpose of the data collection, processing and use

According to the articles of association, the main purpose of the work of DVS is to promote welding and the allied processes beyond the circle of its members. DVS is the pacesetter in questions relating to the joining, cutting and coating of metallic and non-metallic materials as well as of material composites. As a technical-scientific and independent society, it acts in the interests of its members and for the benefit of the German economy. The data is collected, processed and used for the purpose of performing its tasks according to the articles of association.

Description of the groups of people and the collected data

Member and customer data, employee data, data of people active in honorary capacities as well as data of suppliers in so far as this is required for fulfilling the above purposes.

Duration of the storage and erasure of data

In general, data is kept according to the legal stipulations in conformity with commercial and fiscal law (retention obligations) or in order to fulfil the above purposes. Personal data is erased or blocked as soon as this period expires or the purpose of the storage no longer exists. Otherwise, reference is made to Article 17, Paragraph 1 of GDPR.

Your rights as the data subject of the data processing

At any time, you have the right to obtain, free of charge, information about the source, recipient and purpose of your stored personal data which we process in an automated operation on the basis of your consent or in order to fulfil a contract, for yourself or for any third party in a common, machine-readable format. In so far as you demand the direct transfer of the data to any other controller, this only takes place wherever it is technically feasible.

Moreover, you have a right to demand the rectification or erasure of this data. If you have granted consent to the data processing, you can withdraw this consent for the future at any time. The withdrawal does not affect the lawfulness of the data processing carried out until the withdrawal.

Moreover, you have the right to demand the restriction of the processing of your personal data in certain circumstances (Article 18 of GDPR).

If you would like to establish these rights, please direct your inquiry by post or e‑mail with the unambiguous identification of your person to the e‑mail address of the controller (Point 2).

In the case of any infringements of GDPR, you are also entitled to a right to lodge a complaint with the responsible supervisory authority. The right to lodge a complaint exists irrespective of any other legal remedies relating to administrative law or the courts.

Forwarding of data to any third parties

We basically use your personal data only within our company. If we outsource certain parts of the data processing (job processing), we undertake to use your data only in accordance with the requirements of the data protection laws and to guarantee your rights.

Notice about data forwarding to the USA and miscellaneous third states

Amongst other items, tools from companies with their headquarters in the USA or miscellaneous third states which are not secure with regard to data protection law are incorporated into our website. If these tools are active, your personal data may be transferred to these third states and processed there. We are pointing out that no data protection level comparable with the EU can be guaranteed in these countries. For example, US companies are obliged to surrender personal data to security authorities without you as the data subject being able to take any legal action against this. Therefore, it cannot be excluded that US authorities (e.g. secret services) will process, evaluate and permanently store your data located on US servers for monitoring purposes. We do not have any influence on these processing activities.

SSL or TLS encryption

This site uses SSL or TLS encryption for security-related reasons and for the protection of the transfer of confidential contents, e.g. orders or inquiries, which you send to us as the site operator and the controller. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

When the SSL or TLS encryption has been activated, no third parties can also read the data which you transmit to us.

If the conclusion of a fee-based contract leads to an obligation to transmit your payment data (e.g. account number in the case of direct debit authorisation) to us, this data is needed for the payment processing.

The payment transactions via the common means of payment (Visa/MasterCard and direct debit procedure) are carried out exclusively via an encrypted SSL or TLS connection. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

In the case of encrypted communication, no third parties can also read your payment data which you transmit to us.

Objection to advertising e‑mails

An objection is hereby made to the use of any contact data published within the framework of the imprint obligation in order to send any advertising or information materials which have not been expressly requested. DVS expressly reserves the right to take legal steps in the case of the undemanded delivery of any advertising information, e.g. using spam e‑mails.
